1. Acceptance of Terms

By downloading, accessing, or using the NextOp9ja mobile application ("NextOp9ja", "the App", "we", "us", "our") or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or any services provided through it.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and NextOp9ja. We reserve the right to update or modify these Terms at any time. Continued use of the App after any changes constitutes acceptance of the new Terms.

2. Eligibility

By using NextOp9ja, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction;
• You have the full power and authority to enter into this agreement;
• You are a resident of Nigeria or another jurisdiction where NextOp9ja operates;
• You will not use the App for any illegal or unauthorized purpose;
• All information you provide is accurate, current, and complete.

3. Account Registration & Security

You are required to create an account to access certain features of NextOp9ja. You are responsible for maintaining the confidentiality of your login credentials, including your password and transaction PIN. You accept full responsibility for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. NextOp9ja will not be liable for any loss or damage arising from your failure to safeguard your account information.

We reserve the right to suspend or terminate your account if we suspect any unauthorized use, fraudulent activity, or violation of these Terms.

4. Services Description

NextOp9ja provides a virtual top-up platform that enables users to:

• Purchase airtime for mobile networks (MTN, Airtel, Glo, 9Mobile);
• Subscribe to data bundles for all supported networks;
• Pay for cable TV subscriptions (DSTV, GOtv, StarTimes);
• Pay electricity bills across all major DisCos;
• Purchase education pins (WAEC, JAMB);
• Fund and manage a digital wallet.

All services are subject to availability and third-party provider terms. We strive to ensure 100% uptime but do not guarantee uninterrupted service.

5. Wallet & Payments

5.1 Wallet Funding

Users can fund their NextOp9ja wallet via bank transfer, debit/credit card, or virtual account number. All payments are processed through secure third-party payment gateways including Paystack and Monnify.

5.2 Transaction PIN

All transactions require a 4-digit PIN for security. You are solely responsible for keeping your PIN confidential. NextOp9ja will never ask for your PIN outside of the transaction verification process.

5.3 Refunds

If a transaction fails after your wallet has been debited, the amount will be refunded to your wallet automatically. Refund requests for successful transactions are handled on a case-by-case basis. Please contact support for assistance.

5.4 Fees

NextOp9ja charges competitive rates for its services. Any applicable fees will be disclosed before you confirm a transaction. We reserve the right to modify fees with reasonable notice.

6. Subscription Plans

NextOp9ja offers optional subscription plans (Standard, Pro, Plus) that provide discounts on transactions. Subscription fees are charged monthly and are non-refundable. You may cancel your subscription at any time, but no partial refunds will be given for the remaining billing period.

7. User Conduct

You agree not to:

• Use the App for any fraudulent, unlawful, or unauthorized purpose;
• Attempt to gain unauthorized access to any part of the App or its systems;
• Interfere with or disrupt the operation of the App or servers;
• Reverse engineer, decompile, or disassemble any part of the App;
• Use any automated means (bots, scrapers) to access or use the App;
• Impersonate any person or entity or misrepresent your affiliation;
• Engage in any activity that could harm NextOp9ja or its users.

8. Intellectual Property

The NextOp9ja name, logo, app design, and all related content are the exclusive property of NextOp9ja. You may not copy, modify, distribute, or create derivative works without our express written consent.

The App is licensed, not sold, to you. This license is revocable, non-exclusive, non-transferable, and limited to personal use in accordance with these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NextOp9ja and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.

Our total liability for any claim arising from these Terms or the App shall not exceed the total amount you have paid to NextOp9ja in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The App and all services are provided "as is" and "as available" without warranties of any kind, either express or implied. NextOp9ja does not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

We rely on third-party service providers for certain services and are not responsible for their actions, omissions, or service disruptions.

11. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by contacting our support team. Any remaining wallet balance will be refunded in accordance with our refund policy.

12. Third-Party Services

NextOp9ja integrates with third-party services including Paystack, Monnify, UfitPay, MyPayConnect, and others. We are not responsible for the actions, content, or policies of these third parties. Your use of these services is subject to their respective terms.

13. Privacy & Data Protection

Your privacy is important to us. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the App. Continued use of the App after such changes constitutes your acceptance of the new Terms.
